Performing Rights

Performing Rights Organizations

These organizations exist to ensure that the songwriters and publishers of the world are properly paid for the use of their songs, whether it’s performances on radio, television or in concert. The following list starts with Canadian content (pun intended), and then covers the American associations and some of the international ones. SOCAN
The Society of Composers, Authors, & Music Publishers of Canada is a performing rights society, the only national one in Canada (all provinces and territories, including Quebec). Its role is to license the users of music in return for copyright fees.

SOCAN is responsible for collecting the royalties from radio, TV, live concerts and performances, on behalf of the music publisher. SOCAN then distributes these fees, as royalties, to SOCAN members in Canada, and the thousands of foreign music copyright owners whose works the society also licenses in this country. SOCAN's distributions reflect the use of music in Canada. If foreign music is performed, royalties will be paid to foreign copyright owners. If Canadian music is performed in other countries, royalties are then collected by the performing rights agency in that country, (i.e. ASCAP, BMI, or SESAC in the US and the PRS in the UK, etc.) and forwarded to the rightful owner in Canada, through SOCAN.

SOCAN maintains a Head Office in Don Mills, Ontario, with regional offices in Dartmouth, Nova Scotia, Edmonton, Alberta and Vancouver, British Columbia.

ASCAP
The American Society of Composers' Authors & Publishers is a performing arts membership society of over 68,000 active composers, songwriters, lyricists and music publishers. ASCAP was created in 1914 to provide the essential link between the creators of music and the users of music. Besides New York, there are offices in Los Angeles, Nashville, Chicago, London (UK) and Puerto Rico.

BMI
Broadcast Music, Inc. was founded in New York in 1940, and exists to protect the performing rights of over 120,000 songwriters, composers and music publishers; and to distribute royalties to them for those performing rights. From its inception, BMI has supported the creators and copyright holders of the widest possible range of music, including pop, country, rhythm & blues, rock, jazz, Latin, gospel and contemporary concert music. To join BMI, complete an application and sign a contract. No fees or dues are required for songwriters and composers. Publishers pay a one-time $50 processing fee with no further dues or charges. There are offices in New York, Los Angeles, Nashville and London (UK).

SESAC INC.
SESAC, Inc, is a performing rights organization, with headquarters in Nashville and an international office in New York. SESAC was founded in 1930, making it the second oldest performing rights organization in the United States. SESAC's repertory, once limited to European and gospel music, has diversified to include today's most popular music, including dance hits, rock classics, the best of Latina music, the hottest jazz, the hippest country and the coolest contemporary Christian music. SESAC is the smallest of the three U.S. performing rights organizations (ASCAP & BMI).

PRS
The Performing Rights Society is the UK association of composers, songwriters and music publishers. It administers the "performing right" in their music. Whenever copyright music is heard in public the people who own the copyright in the work are entitled by law to give permission and should get paid by the music user. But, the people who create and publish the music need help to give that permission (license their music) and to collect the fees due. So they give PRS the right to do both on their behalf.

CISAC
Confederation Internationale des Societes D'Auteurs, et Compositeurs/ International Confederation of Societies of Authors & Composers, is a non-profit, non-governmental organization embracing 161 members (159 societies and two organizations) representing creators in 87 countries. It was founded in 1926 in Paris where its headquarters still exist today. It represents more than a million creators of musical, dramatic, literary and audio-visual works and of works of visual art (such as fine art, sculpture, photography and illustration).

CISAC is officially accredited with UNESCO, WIPO (The World Intellectual Property Organization), the Council of Europe, and the European Community, where CISAC makes the voice of creators heard and defends their interests. In agreement with its member Societies, it encourages governments to improve legislation protecting creators.
